The Allied Chemical Corporation (located in Metropolis, Illinois), Atomic Energy Commission (AEC), and Mallinckrodt Chemical Works had a contractual relationship working on behalf of the AEC and Department of Energy (DOE) delivering uranium feed (UF6) to the Paducah AEC/DOE plant. The DOE provided evidence under the "Freedom of Information Act" confirming the existence of the DOE Contract AT-(40-1)-1798. Jones Family Trust beneficiaries, led by Nuclear Whistleblower/DOJ & FBI Witness Gary S. Vander Boegh, provided federal investigators with evidence that Bank of Oklahoma conspired with new Jones Family Trust beneficiaries to "waive" major lease breaches and contract violations to give co-operators Martin Marietta and Lafarge an unfair competitive advantage in the aggregate market place. The FBI had visited the Three Rivers Quarry after receiving emails from Gary Vander Boegh and Mark Vander Boegh on their FBI hotline! The FBII then began their investigation that can include, Money Laundering, Obstruction of Justice, Theft from Interstate Shipment, and Interstate Transportation of Stolen Property.
NAMED eneficiaries Mark Vander Boegh and Gary Vander Boegh became suspicious after the replacement Trustee "terminated" the JFT reopener "TEAM" in 2006 without explanation, including the termination of their very own LEAD attorney Charles Shivel who had been instrumental in working with Gary Vander Boegh, Mark Vander Boegh, & BOK Trustee Bobby Brooks who was also terminated 4 months before Mr. Shivel. Mr. Shivel and Bobby Brooks were in the process of performing the required aerial flyovers prior to proceeding to arbitration, when they each were terminated by SKO. BOK and their attorneys Joe Higgins and attorney John Bilby (close friend of Alliance Recourses Partnership CEO Joseph Craft III (and wife Kelly Craft Donald Trump's ambassador to Canada) were fully aware Martin Marietta and Lafarge ence Coal were not be paying royalties per the terms of the Jones Family leases. At least two beneficiaries were found to acquired financial "windfalls" after they began promoting "waiving contract/ lease violations". These very same Jones Family Trust beneficiaries were closely associated with "protecting" BOK Tulsa officers and refused to terminate the BOK Trustee stating their only reason NOT to terminate them was they were "NICE!" The extent of their "complicity" is under investigation at this time, but what is known at this time is that on 9/28/17, former PGDP nuclear Whistleblower Gary S. Vander Boegh provided President Donald J. Trump, Attorney General Jeff Sessions, and Christopher Wray with evidence that BOKF had, in fact, violated the Security and Exchange Commissions rules and laws of the Commonwealth of Kentucky, as early as 2006, when they conspired with Martin Marietta CEO Steve Zelnick to withhold "actual" daily and monthly production records that reflected "huge shipping differentials." New beneficiaries Lisa Price and Kimberly Faith Jones are currently under close scrutiny and will present their testimonies under oath for their reasons for defending the Bank of Oklahoma "after" they received settlements in the amount of six figures during a prior lawsuit against Old National Bank that also waived similar lease breaches before in a lawsuit brought before U.S "Senior" Federal Judge Thomas B. Russell. In the family's prior lawsuit against Martin Marietta, Old National waived lease breaches that could have allowed the family to obtain a "fair market" lease. In that previous federal lawsuit Judge Russell ruled the removal of 2000 cubic yards was a "material lease breach", but Old National Bank "waived" the non-monetary lease breach by accepting the "Monthly" royalty payment before filing the default. Beneficiary Lisa Price and cousin Kimberly Faith Jones began to suspiciously refuse to enforce the very same "strong default" provision that within a few months had produced a seven figure settlement with Martin Marietta. Documents confirmed Ms. Price had been "privately" communicating with Martin Marietta attorneys Thomas Herman and Rosiland Barr, leading former MMM engineer Gary Vander Boegh to file an "SEC" complaint in April 2011.
A copy of Mr.Shivel's "Reguest for Information" well before the family's first reopener in 30 years revealed that beneficiaries Kimberly Faith Jones, Lisa and John Price had been in possession of evidence that Martin Marietta CEO Steve Zelnick was fully aware that royalties had not been accurately tabulated for payment of royalties in years.

The majority beneficiaries (15) most named in the original Eula K. and Charles R. Jones Trusts, fired/terminated the Bank of Oklahoma (BOK) for conspiring with the "Operators" of the Three Rivers Rock Quarry. Attorneys for the Bank of Oklahoma John Bilby and NEW JFT beneficiaries conspired to "waive" breaches in violation of the lease documents. on January 16, 2018, the Lafarge-Holcim Corporation admitted to the Trustee limestone had been shipped without payment of royalties to the family. Upon learning of the Lafarge admission of "non-monetary" breaches, on February 19, 2018 the majority beneficiaries terminated BOK and placed Lafarge-Holcim after BOK refused to terminate the lease as required by the lease documents. The shipment of limestone from the Commonwealth of Kentucky without payment may constitue further violations of federal law.

On August 8, 2017, 50 year JFT beneficiary Gary S. Vander Boegh requested and received proof by facsimile provided by Bank of Oklahoma (BOK) Trust Officer Ms. Denise Cramer that confirmed BOK had deleted evidence from the official Trust files. This evidence was deleted from the BOK official reports to the beneficiaries. The information deleted confirmed over 430 million tons of "high calcium carbonate" limestone on site in 2006. The permit documents were submitted to the "Kentucky Division of Non-Coal", the agency that regulates limestone mines in the Commonwealth of Kentucky. With the permit documents in hand, and provided to BOK in June 2006, the Board of Directors of the BOK conspired to "keep royalties low" while shipping millions of tons of high calcium carbonate limestone to "BIG COAL OPERATORS" yet to be named. BOK Trustees concealed and misrepresented limestone tons produced and shipped "downstream" without payment.

Department of Energy FOIA Request Confirms Allied Chemical Honeywell Status as DOE facility

The Department of Energy under the Freedom of Information Act (FOIA) recently provided to Commonwealth Environmental Services, LLC (CES) information that confirmed the Allied Chemical Honeywell (ACH)facility located in Metropolis, Illinois, was under contract with the "Atomic Energy Commission" (AEC) to produce UF6 for use by the U.S. Government. Until the DOE provided evidence of a contractual/service agreement between ACH and AEC, the Department of Labor contractors would not recognize ACH workers under Part E of the EEOICPA thus denying key/ critical medical benefits for ACH worker illnesses linked to their exposures to toxic substances at the ACH facility. Although DOL contractors continued to refuse workers requests to apply for Part E compensation and medical benefits, CES applied on their behalf. Claims reopening requests are now pending with the DEEOICP Director Rachel Leiton with copies of the requests provided to the attention of the DOL Ombudsman Malcolm Nelson and Secretary of Labor Thomas Perez.

and public health and safety, and the status of legacy issues, this Department of Energy (DOE) Office of
Oversight investigation was divided into two phases. Phase I, the subject of this report, covers the period
from 1990 to the present. Phase II, which will begin in October 1999, will evaluate ES&H performance
and concerns about Plant operations prior to 1990. Various assessments in the early 1990s, including a
DOE Tiger Team and the initial investigation under the DOE Environmental Protection Agency Consent
Order, identified numerous concerns about environmental contamination, radiological protection, and the
presence of transuranic materials.

President Donald Trump continues to promote and deny claimants EEOICPA claims by refusing to follow decisions by federal Judges who rule against the Department of Labor. President Trump continues to refuse to "Terminate" DOL rogue DOL and OIG officials connected to DOL Scott Dahl's termination of DOL Whistleblower Steven Silbiger. Notice of the pending termination of Mr. Silbige was emailed Presdent Trump before Silbiger's termination! CES claimants were then punished for using Gary S. Vander Boegh as their "Authorized Representative" for exposing Senator McConnell's incestuous relationship with "Cold War Patriouts" who are a front for Pro Case Management's attempts to damage medical providers rights to treat nuclear workers who use independent "Authorized Representatives" who do not wish for their claimants to incur additional costs for their medical treatments. CWP/PCM are under investigation for attempting to take over and intimidate other nuclear health care firms. Greg Austin and Tim Lerew were recorded on several occasions attempting to "monopolize" the nuclear health care market by threatening AR's and other providers, even ordering attacks on Authorized Representative during meetings with DOL Malcolm Nelson and other DOL officials. Officials at the DOL and DOJ were made aware these suspicious activities that appeared to threaten people at public meetings if they attempted to ask questions. DOL Ombudsman and Paducah and Portsmouth Officials witnessed the abuse by CWP/PCM who became DOL's sole "point of contacts" for ALL "Authorized Representatives" (AR) that were associated with them by contract. "AR's" that refused to "Play Their Games!" Were attacked and threatened by local officials aligned with them, including Paducah Mayors and Law Enforcement Officials yet to be named! Complaints were prepared but not served on the individuals involved in their "Strong Arm Tactics", causing others become suspicious of Paducah Police serving as guards, but instead performing as Gestapo agents for Public officials.

This "DRAFT" report provides the results of an independent audit conducted by S. Cohen and Associates (SC&A) of the technical basis documents (TBDs) that make up the site profile for the Paducah Gaseous Diffusion Plant (PGDP) developed by the National Institute of Occupational Safety and Health (NIOSH). This audit was conducted during the period April 2006–September 2006 in support of the Advisory Board on Radiation and Worker Health (Advisory Board) in the latter’s statutory responsibility under the Energy Employees Occupational Illness Compensation Program Act (EEOICPA) to conduct such reviews and to advise the Secretary of Health and Human Services (HHS) on the “completeness and adequacy” of the EEOICPA program.
SC&A notes that this review was triggered in part by concerns raised in a letter by Richard
Miller (see Attachment 1) to the Secretary of HHS and the Director of NIOSH. Mr. Miller was
concerned that the principal author of the Occupational Internal Dose TBD had serious conflict of interest (COI) issues and that the technical credibility of that TBD was questionable as well.
As a result, particular emphasis has been placed on the review of that document.

Members of Congress and officials from the Department of Justice have been made aware that the Department of Energy inserted in June 2002 an erroneous date of July 1952 as a date of first exposure" to radiation at the Paducah Gaseous Diffusion Planat (PGDP). Testimony presented at a recent Department of Labor "Final Adjudication Branch" (FAB) hearing, attended by an aide from Senator Richard Durbin's office, indicates that radiologically contaminated "process equipment and piping" was transported from the Oak Ridge gaseous diffusion plants and delivered to the PGDP as early as 1951 Therefore, the minumum 250 days a PGDP employee must have worked before February 1992 should be "reaffirmed" as the sole radiological exposure date criteria.

Response Received for DOE Rad Equipment Shipping Records

In response to Commonwealth Environmental Services (CES) request for equipment shipping manifests and shipping records, the Department of Energy has directed the DOE managers (William Murphie, Ray Miskelly, and Rachel Blumenfeld) to relase all records that will confirm that radioactive equipment contaminated at other AEC sites was shipped to the Paducah Gaseous Diffusion Plant well before enrichment operations began in July 1952, thus exposing construction workers earlier than DOE had previously reported.

An amendment to the Paducah Special Exposure Cohort dates of initial exposure is currently be prepared with the input from NOISH and the DOL.

Per the Energy Employee Occupational Illness Compensation Program Act EEOICPA and Executive Order 13179, the Department of Labor (DOL). In many instances a claimant cannot be assured the DOL claims examiner has been provided or has reviewed relevant records, until decisons are rendered that appear to disregard actual medical documentation. In many instances the claimant's personal physicians medical reports are not evaluated or considered in support of the specific claim, with DOL instead soliticing "subjective" medical opionions from DOL contractors rather than "Objective" interpretatons based on the federal statutes and regulations.

In a Unanimous 9-0 opinion and order, on March 9, 2015, the United States Supreme Court ruled that internal "interpretative" procedures "DO NOT CARRY THE FORCE AND EFFECT OF LAW" and only to be used as guidance ONLY! The Obama Administration refused to follow the guidance issued by the U.S. Supreme Court which led to thousands of valid EEOICP claims illegally denied by the DEEOICP Director who refused to comply with the U.S. Supreme Court Decision and Order! The result was that as many as 15,000 nuclear worker claims (Senator McConnell constituents) from the Paducah Gaseous Diffusion Plant were purposely denied by using internal procedures, letters, memo's, directives, circulars, etc. that did not carry the force and effect of law or "rule making!"
